Drift Nimbus (Pvt) Ltd, a company legally registered in Zimbabwe, and referred to in this document as (“Drift Nimbus,” “we,” “us,” or “our”), is committed to respecting and protecting the personal information and data of its visitors and customers. This Privacy Policy outlines how we collect, use, disclose, store, and protect your personal information when you use our website at www.driftnimbus.com and all associated products and services (collectively, “Services”).
Drift Nimbus does not discriminate against individuals for exercising their privacy rights under applicable laws. This Policy is incorporated into, and made a part of, the Terms of Service (“TOS”) Agreement found on our Website.

The information that Drift Nimbus collects is hosted on servers located primarily within South Africa, unless otherwise provided. By using Drift Nimbus’s services, you freely and expressly give Drift Nimbus your consent to process and store your information and data within South Africa.
2. Use of Information
Drift Nimbus does NOT trade, rent, or sell your personal information or data to any other organization or third party, except as provided specifically in this Policy.
We use the information we collect for the following purposes:
Service Provision: To provide, operate, and maintain your web hosting solutions, email services (Nimbus Mail), financial management software (Nimbus Books), website building tools (Kuona Website Builder), sales tracking applications (Nimbus Sales), and other services you request.
Account Management: To manage your account, including billing, invoicing, and customer support.
Product Improvement: To analyze usage patterns, diagnose technical problems, conduct research, and improve our products and Services.
Communication: To respond to your inquiries, send you transactional notices, updates about your account, newsletters, and news of special promotions from Drift Nimbus and/or our partners.
Personalization: To provide a customized experience as you use Drift Nimbus’s Services, including tailored advertisements where applicable.
Analytics and Statistics: To gather broad demographic information, analyze website traffic, and optimize our Website and Services. Any statistics gathered by Drift Nimbus are our proprietary property.

Drift Nimbus may share your personal information in the following circumstances:
Aggregated and Non-Identifying Information: We may share aggregated and non-identifying information about customers (e.g., from registration, surveys) with advertisers or partners to deliver tailored advertisements. This information does not personally identify you.
Legal Compliance and Protection: We may access, preserve, and share customer information with companies, organizations, governmental entities, or individuals outside of Drift Nimbus if we believe, in good faith and in our sole discretion, that the law requires us to do so. This includes, but is not limited to, responding to subpoenas, court orders, or other legal processes, or as necessary to establish or exercise Drift Nimbus’s legal rights, defend against claims, investigate suspected fraud or illegal activities, prevent death or serious physical harm, or investigate violations of our Terms of Service.
Domain Registration (WHOIS): For certain domain registrations, your information may be made publicly available through a “WHOIS” search as required by ICANN or specific registries. Drift Nimbus may deposit your domain registration information with a third-party escrow provider to comply with ICANN requirements. We do not control the use of WHOIS information by third parties, and any solicitations or SPAM resulting from such searches do not originate from Drift Nimbus.
Business Transfers: In the event of a merger, acquisition, or sale of all or a portion of our assets, your personal information may be transferred as part of that transaction.
4. Data Security
Drift Nimbus employs multiple security measures to prevent the loss, misuse, and alteration of the information under our control. Your data is protected using Secure Socket Layer (SSL) encryption technology, an industry standard designed to ensure the accuracy and security of customer information. In the unlikely event of a data breach, Drift Nimbus will notify the appropriate regulatory and/or legal authorities, as well as affected customers/individuals, within seventy-two (72) hours, where required by law.

You can exercise these rights by accessing your Account Manager or by contacting our support team via email (info@driftnimbus.com), phone, or online chat. We may request certain personal information to verify your identity. Requested information will be provided within a reasonable timeframe, typically forty-five (45) days, unless otherwise required by law.
Accessing, Modifying & Deleting Your Information: You can access, update, and correct inaccuracies in your personal information in our custody. You may also request the erasure of your personal information. We will inform you if we are unable to fulfill your request and the reasons why.
Unsubscribe/Opt-out: When you become a customer, you are automatically subscribed to transactional notices and promotional communications. You can update your preferences or unsubscribe from newsletters and promotional mailings through your Account Manager or via the links provided in promotional emails.
Public Forums: Be advised that any information you disclose or post in forums or other public areas of Drift Nimbus’s website or the Internet becomes public information. Right to Access: You have the right to request access to your personal information held by Drift Nimbus.
Right to Request Correction, Destruction or Deletion: You may request the correction, destruction, or deletion of your personal information that is inaccurate, irrelevant, excessive, out of date, incomplete, misleading, or obtained unlawfully.
Right to Object to Processing: You have the right to object, on reasonable grounds, to the processing of your personal information (e.g., for direct marketing).

8. Children Under 18
Drift Nimbus does not sell products or services for purchase by children. Our Services are intended for individuals who are at least 18 years of age. Any individual under the age of 18 (“Minor”) must have a parent or guardian accept the Terms of Service for the Minor to become a customer. If you are under 18, we strongly encourage you to use our Website and Services only with the involvement of a parent or guardian.
9. International Transfers
The personal data we collect within your country may be transferred outside of your country to Drift Nimbus or its third-party contractors or service providers for the purposes described in this Privacy Policy, particularly for hosting and data processing facilities located primarily in South Africa.
